Set background image to appear only on certain pages

I'm having a bit of trouble wrapping my head around the background images idea of GP premium. I added a background image and it's working fine (I may have kinda-sorta copied GP-main style!) The problem I'm having is I don't want the background image on all pages. Is there a way to add it to the elements portion so it only shows up if I'm using a certain header?

The 2nd problem I'm having with it is that I want a what menu if the background image isn't used and a transparent one if it is in use.

If so using the header element should be the way to go:
